“Chile hacia la vanguardia”: Académicos y representantes de organizaciones ambientales de todo el mundo apoyan proyecto constitucional

Mediante una declaración firmada por 250 académicos y miembros de organizaciones ambientales de 40 países, el ambientalismo internacional felicita que la propuesta de Nueva Constitución para Chile sea la primera del mundo en reconocer la crisis climática y ecológica, y afirman que “presenta lecciones indispensables para países de la región y el mundo”

El país ubicado en el extremo austral del planeta, por primera vez en su historia ha escrito una constitución democrática y ahora se apronta a la decisión definitoria en el que la ciudadanía deberá votar si aprueba el texto propuesto por la Convención Constitucional o lo rechaza, continuando así con la escrita en 1980, durante la dictadura militar.

Entre las características de la propuesta, destaca un cambio a la forma en que se concibe el Estado, pasando de ser subsidiario a un Estado social y democrático de derecho, a esto se suman 98 artículos que a lo largo de todo el texto le dan al país un visión de resguardo y respeto del medio ambiente en todos los ámbitos de la vida. De esta forma, se establece la obligación de que el Estado adopte una administración ecológicamente responsable, y medidas de prevención, adaptación y mitigación de los riesgos que genere esta crisis. En esa línea, el proyecto constitucional chileno propone una estructura normativa interna robusta, y que realza la cooperación internacional para enfrentar el cambio climático y la degradación de nuestra biodiversidad.

“La propuesta de la Nueva Constitución en Chile reconoce el derecho a un ambiente sano como un derecho humano y los derechos de la Naturaleza. El proceso de elaboración inclusivo que buscó respuestas nuevas a la crisis climática en que vivimos marca un camino que sirve de inspiración al mundo”, señala Patricia Madrigal, ex viceministra de medio ambiente de Costa Rica.

Por su parte, el académico de la Universidad de Viena, Ulrich Brand, comentó que este proyecto constitucional es “una valiosa caja de herramientas para cambiar el modelo económico a uno post-extractivista”.

La misiva fue firmada por profesores e investigadores de universidades de todo el mundo, incluyendo la Universidad de Helsinki, la Universidad Autónoma de Barcelona, la London School of Economics, la Universidad Federal de Sao Paulo, la Universidad de Medellín, Georgetown University y la Universidad de Lausanne, entre otros. También fue suscrita por miembros de reconocidas organizaciones ambientales globales, tales como Fridays for Future, Climate Action Network, FIAN International, GAIA Foundation, 350.org y el Instituto de Clima y Sociedad. En la misiva las y los firmantes expresan la esperanza que les genera que desde Chile se establezca un marco de ambición coherente con los desafíos climáticos y ecológicos actuales, demostrando la solidaridad de los y las chilenas con la lucha climática global y que esperamos sea fuente de inspiración para el mundo.

“Desde nuestros espacios, organizaciones y comunidades, esperamos con entusiasmo que se apruebe la nueva Constitución de Chile y saludamos con mucho afecto al pueblo chileno. La nueva Constitución Ecológica de Chile, será también nuestra Constitución Ecológica”, puntualizan.

Chile at the forefront

Academics and environmental advocates from all over the world support Chile’s new Constitution

Through a statement signed by 250 academics and representatives of environmental organisations from more than 40 countries, the international climate movement embraces Chile’ proposed new Constitution and recognises it as the first to address the climate and ecological crisis. “It presents indispensable lessons for countries in the region and the world”, they said.

Chile has written a democratic Constitution for the first time in its history, and is now getting ready for the definitive decision in which the citizens will have to vote whether to approve the text proposed by the Constitutional Convention or reject it, thus continuing with the one written in 1980, during the military dictatorship. The decision will be made on September 4th.

Among the characteristics of the proposal, there is a change in the way the State is conceived, going from being subsidiary to a social and democratic State of law, in addition to 98 articles that give the country a vision of protection and respect for the environment in all areas of life. Among others, the new Constitutional text establishes the obligation of the State to adopt an ecologically responsible administration, and measures of prevention, adaptation and mitigation of the risks generated by the climate crisis. In this line, the Chilean constitutional project proposes a robust internal regulatory structure, and enhances international cooperation to address climate change and the degradation of our biodiversity.

“The proposed New Constitution in Chile recognizes the right to a healthy environment as a human right and the rights of Nature. The inclusive drafting process that sought new responses to the climate crisis in which we live marks a path that serves as an inspiration to the world,” said Patricia Madrigal, former Vice Minister of the Environment of Costa Rica.

Ulrich Brand, an academic at the University of Vienna, commented that this constitutional project is “a valuable toolbox for changing the economic model to a post-extractivist one”.

The statement was signed by professors and researchers from universities around the world, including the University of Helsinki, the Autonomous University of Barcelona, ​​the London School of Economics, the Federal University of Sao Paulo, the University of Medellin, Georgetown University and the University of Lausanne, among others. It was also signed by members of well-known global environmental organisations, such as Fridays for Future, Climate Action Network, FIAN International, GAIA Foundation, 350.org and the Institute for Climate and Society. In the statement, the signatories express their hope that Chile will establish a framework of ambition consistent with the current climate and ecological challenges, demonstrating the solidarity of Chilean men and women with the global climate struggle, and that we hope it will be a source of inspiration for the world.

“From our spaces, organisations and communities, we look forward to the approval of the new Constitution of Chile and we greet the Chilean people with great affection. The new Ecological Constitution of Chile will also be our Ecological Constitution”, the statement points out.
